Welcome to the Sit Still website! We at Sit Still, Inc. (“Sit Still,” “we” or “us”) take the privacy of our clients very seriously. This Privacy Policy describes our privacy practices related to your use of our website sitstillkids.com and your options to exercise your privacy rights. This Privacy Policy is governed by our website Terms of Use[1] .

BY USING THIS WEBSITE, YOU AGREE TO BE BOUND BY THIS ONLINE PRIVACY POLICY. IF YOU DO NOT AGREE TO THIS ONLINE PRIVACY POLICY, DO NOT USE THE WEBSITE OR SUBMIT PERSONAL INFORMATION TO US IN ANY MANNER.

1. Definition of “Personal Information”

As used in this Privacy Policy, “Personal Information” means any information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household. We generally describe Personal Information as falling within categories like identifiers, sensitive information (e.g., government ID, health information, or information about one’s race or religion), legally protected information (e.g., race, citizenship, marital status, sex), employment or educational information, biometrics, commercial information, internet activity, or inferences drawn from other Personal Information to create a profile. Not all information about a person is protected as Personal Information. Information that is publicly available, aggregated (data summaries or reports with Personal Information removed), or anonymized is often exempt from privacy laws.  

2. Children’s Privacy

Sit Still operates modern hair salons for kids, but our website is for adults only. No one under the age of 18 should access or use the website in any manner. If we learn that we have collected or received Personal Information from a child under 18, we will delete that information. If you believe we might have any information from or about a child under 18, please contact hello@sitstillkids.com.

3. Collection & Use of Personal Information

We collect Personal Information when you use certain website features like Book Now to book an appointment or send us messages online. In most cases, we collect and use Personal Information with your consent. For some uses, we may have a legitimate interest, or we may use Personal Information to comply with the law. In all cases, we only collect, use, retain, and disclose Personal Information as is adequate and relevant to the specific, express purposes described in this Privacy Policy, or as reasonably necessary, proportionate, and compatible with the context of how we collected your Personal Information. Over the last 12 months, Sit Still has collected and used Personal Information through the website as follows:

  • Appointment Booking. When you book an appointment through the website, we will collect your email address, first and last name, pronouns (optional), and cell phone number. You can choose to provide information about any special needs your child may have during the appointment. You have the option to select a password to create an account for easy future bookings. If you share your child’s birthday, Sit Still may send your child a birthday card! Payment information is stored and processed by a secure third-party payment processor. We collect this information with your consent, and we use it to facilitate your booking and to communicate with you about your appointment.

  • Newsletter Signup. When you sign up for the Latest + Greatest, our email newsletter, you voluntarily provide your email address and consent to receive our newsletter, which may include promotions and other marketing content. You can unsubscribe at any time by following the instructions in any newsletter email message. 

  • Messages You Send to Sit Still. You have the option to contact us through our website or our social media channels. Any Personal Information you include in your message is provided with your consent. We will use that information to respond to your inquiry, provide you with the services you request, and send you updates. You can unsubscribe from our communications at any time by following the instructions in our emails or by unfollowing our accounts on social media.

  • Call Recording. Some Sit Still salons use call recording for quality monitoring, training, or to improve our customer service. You will be notified if your call is being recorded. By staying on the line after receiving the notification, you consent to the call recording. If you do not consent to call recording, you may end the call or ask to not be recorded.

  • Your Activity on the Website. Like most commercial websites, our website is built using Squarespace, and may use cookies and related technologies to analyze trends, facilitate user sessions, and enable certain features and functions on the website. Data we collect through cookies is never shared with third parties. We collect this data to achieve our legitimate interest of maintaining and improving our online presence. You can learn more about the cookies Squarespace uses. You can adjust your settings on the Services or your device or you can install a third-party plugin to block cookies or alert you when a cookie is set, but doing so may prevent you from using some or all of the features on the Services.

  • Additionally, we may use the Personal Information collected through the website to (i) monitor your compliance with our terms and conditions; (ii) protect the privacy of consumers; (iii) if we believe it is necessary, to identify, contact, or bring legal action against persons or entities who may be causing injury to you, to us, or to others; (iv) comply with a law, regulation, legal process, or court order; or (v) fulfill any other purpose to which you consent. We will not collect additional categories of Personal Information or use already collected Personal Information for purposes that are materially different, unrelated, or not reasonably necessary or compatible with the original purpose without notice and consent to you as required by law.

4. Disclosure to Third Parties

Sit Still relies on service providers and other third parties to operate our website and provide our services. We will only disclose Personal Information to third parties as described in this section, with your permission, or as required by law. Your consent to Sit Still’s privacy practices is also your consent to these third parties accessing and processing your Personal Information as described below. Over the last 12 months, we have disclosed Personal Information to:

  • Our Service Providers. We work with third parties that provide Sit Still with software and other technology to provide certain functions or features through the website. As part of our commitment to your privacy, we are careful to only work with technology providers that offer robust privacy and data protection programs. For example, HighLevel is our primary technology platform and we use Boulevard salon software. We also work with payment processors, analytics companies, and other technology support providers. We prohibit our service providers from selling or disclosing the Personal Information we provide, and we require all service providers to maintain confidentiality standards and appropriate technical and organizational measures to ensure the security of your Personal Information.

  • Law Enforcement, and other governmental agencies, as permitted or required by law.

  • Other Disclosures, as permitted by applicable law. For example, if we go through a business transition, to comply with a legal requirement or a court order, to prevent fraud or exercise or defend our legal claims, or for any other reason with your consent.

  • Aggregated and Deidentified Information. Sit Still reserves the right to share aggregated, anonymized, or de-identified information about any individuals with nonaffiliated entities for any purpose without restriction.

5. Retention of Personal Information

Sit Still retains Personal Information for the minimum period necessary to fulfill the purposes of its collection or to fulfill our internal business purposes. Your appointment and account information is retained as long as your account remains active or until you ask us to delete it. If you are on our newsletter email list, we will keep your email address until you unsubscribe. Cookie data is retained for as little as a few minutes or as long as 24 months. Sit Still reserves the right to retain data for longer periods as required by law or court order or if doing so is critical to our business.

6. Data Security

Sit Still has implemented and maintains reasonable security measures to secure your Personal Information from accidental loss and unauthorized access, use, alteration, and disclosure. We are careful to only work with technology providers that offer industry-leading security mechanisms, including secure logins, regular testing and data backups, and encryption in transit and at rest.  All data, including client Personal Information, is stored on secure servers located in the United States. Sit Still is committed to ensuring that our security measures are appropriate to the volume, scope, and nature of the Personal Information processed and designed to meet our duty of care with respect to your Personal Information.

You are responsible for keeping your device access and login information confidential. You are also encouraged to install anti-virus and anti-malware software on your devices and keep all software updated to avoid security risks. We cannot guarantee the security of the information you submit while it is in transit over the Internet, and any such submission is at your own risk.

7. Your Privacy Controls

You can directly control how we collect and use your Personal Information:

  • Your Account. You can access, correct or update, or delete certain Personal Information by logging into your account and saving your changes.

  • Our Newsletters and Emails. We will send you our newsletter and other email messages related to your appointments and the messages you have signed up to receive.  You can unsubscribe from our emails at any time by clicking the link at the bottom of any Sit Still email. If you opt out of marketing emails, we may still send you informational messages about your appointments.

  • Text Alerts. If you provide us with your cell number and consent to receive texts from Sit Still, we will send you appointment alerts and other messages. We will only send you marketing text messages if you opt-in to receive them. The number of texts you receive will depend on your appointments and the information you request from Sit Still. You can unsubscribe by replying STOP to any of these text messages. Messaging and data charges may apply to any text message you receive or send. Please contact your wireless carrier if you have questions about messaging or data charges.

  • Your Device Settings. You can control the data we collect through cookies and related technologies by adjusting your device settings.

  • Do Not Track. Do Not Track signals are signals sent through a browser informing us that you do not want to be tracked. Currently, our systems do not recognize browser “do-not-track” requests.

  • Block Location Tracking. You can stop all collection of information by an app by uninstalling it. You can also reset your device Ad Id at any time through your device settings, which is designed to allow you to limit the use of information collected about you. You can stop all collection of precise location data through an app by uninstalling the app or withdrawing your consent through your device settings.

8. Your Privacy Rights

In the United States, consumer privacy is governed by federal privacy laws covering specific industries or data uses and state privacy laws providing general consumer privacy rights. This section offers informational notices for privacy laws governing U.S. states that require companies to notify consumers about their privacy rights. Residents of states offering privacy protections (e.g., California, Colorado, Connecticut, Nevada, Utah, Virginia, and others) can exercise their privacy rights as applicable to our Services by submitting a Privacy Request.

Depending on where you live, you may be entitled to some or all of the following privacy rights:

●        Right to Correct. You have the right to correct your Personal Information if it is inaccurate. You can update your account or alert Sit Still that your information is incorrect so we can update it.

●        Right to Deletion. You may request that we delete the Personal Information that we hold about you, with exceptions. If you request deletion, we may permanently delete, deidentify, or aggregate the Personal Information.

  • Right to Access. You can request that we confirm whether we have collected Personal Information about you and provide you with access to that Personal Information. If you request access, we will provide you with copies of the requested pieces of Personal Information in a portable and readily usable format. Please note that we may be prohibited by law from disclosing certain pieces of Personal Information, and we may be limited in the number or frequency of requests we must fulfill. 

  • No Selling or Sharing. Some states entitle consumers to opt-out of the sale or sharing of Personal Information or targeted advertising practices. Sit Still does not sell your Personal Information or share Personal Information with third parties for cross-contextual behavioral advertising purposes. If this changes in the future, we will update this Privacy Policy and provide you with a method to opt-out.

  • Limited Use and Disclosure of Sensitive Information. Sit Still does not intend to collect any sensitive information. If you choose to submit sensitive information to us, we would not share it with third parties for any purpose other than providing you with the services you request.

  • No Profiling. Sit Still does use any form of automated profiling.

  • Right to Disclosure. You may request that we disclose information to you about our collection and use of your Personal Information, such as: (i) the categories of Personal Information we have collected about you; (ii) the categories of sources for the Personal Information we have collected about you; (iii) our business purpose for collecting, using, processing, sharing or selling that Personal Information, as applicable; (iv) the categories of third parties with whom we share that Personal Information; and (v) if we sold or shared (as defined by statute) your Personal Information, two separate lists stating: (a) sales or sharing, identifying the Personal Information categories that each category of recipient purchased; and (b) disclosures for a business purpose, identifying the Personal Information categories that each category of recipient obtained. Certain laws may limit the number or frequency of requests we must fulfill.  

  • Right to Disclosure of Marketing Information. California’s Shine the Light Act (Civil Code sections 1798.83-1798.84) entitles California residents to request certain disclosures regarding Personal Information sharing with affiliates and/or third parties for marketing purposes.

  • Right to Nondiscrimination. Sit Still will not discriminate against you for exercising your privacy rights. We will not: (i) deny you goods or services; (ii) charge you different prices or rates for goods or services; (iii) provide you a different level or quality of goods or services; (iv) retaliate against you as an employee, applicant for employment, or independent contractor for exercising your privacy rights; or (v) suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services because you exercised a right under applicable privacy laws.

  • To exercise your rights under applicable privacy laws, or if you want to express concerns, revoke your consent, lodge a complaint, or request information, please submit a privacy request to hello@sitstill.com.

  • We can only assist with or fulfill a privacy request when we have sufficient information to verify that the requester is the person or an authorized representative of the person about whom we have collected Personal Information, and to properly understand, evaluate, and respond to the request. We do not charge a fee to process or respond to a verifiable request unless we have legal grounds to do so. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request. We endeavor to respond to privacy requests in accordance with the requirements of the law applicable to your jurisdiction. 9. Owned and Operated in the United States

Sit Still is owned and operated in the United States. All our salon locations are in the United States, and we only market to clients located in areas where our salons are located. If you access the website from outside the United States, please be aware that your Personal Information may be transferred to, processed, stored, and used in the United States or other jurisdictions. When your information is moved from your home country to another country, the laws that protect your Personal Information in the country to which your information is transferred may be different from those of the country where you live. For example, if your information is in the United States, it may be accessed by government authorities under United States law.

Our website may offer links to websites and other services offered by third parties. These links are provided for convenience only. Sit Still has no control over these third-party websites and services.


11. Privacy Updates

Sit Still may update this Privacy Policy as needed from time to time. You can see when this Privacy Policy was last updated by checking the “last updated” date displayed at the top of this Privacy Policy. We will notify you about material changes to this Privacy Policy by email or by other measures that are appropriate to provide you with notice. We will collect your consent to these changes to the extent required by applicable law.
